The petitioners seek bail in anticipation of their arrest in connection with Nagar P.S. Case No. 1103 of 2019 dated 17.09.2019 instituted for the offence under Sections 147, 148, 149, 341, 323, 504, 506, 509, 354 and 379 of the Indian Penal Code.

Three accused persons including the petitioners are alleged to have assaulted the informant and his father.

No.25664 of 2020(2) dt.14-10-2020 2/3 However, the specific act of assault has been attributed to one Satish Singh, who is said to have assaulted the father of the informant with the butt of a pistol, which injured him on his head. One Bina Devi is said to have assaulted the mother of the informant and accused Satish Singh tried to outrage the modesty of the mother of the informant.

It has been submitted on behalf of the petitioners that an absolutely false case has been instituted against them. The parties are agnates and because of some land dispute, an altercation had taken place prior to the present occurrence. With respect to the aforesaid prior occurrence, the wife of petitioner no. 1 has also lodged a case vide Town P.S. Case No. 1082 of 2019 on 15.09.2019. Only after two days of lodging of the aforementioned case, present case has been lodged.

Considering the general nature of accusation against the above named two petitioners and the circumstances under which, the occurrence is said to have taken place, they are directed to be released on bail, in the event of their arrest or surrender before the court below

No.25664 of 2020(2) dt.14-10-2020 3/3 within a period of eight weeks from the date of receipt / production of a copy of this order, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada, in connection with Nagar P.S. Case No. 1103 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
