2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 354 (A), 354©, 354 (D), 420, 292 (A), 509 & 34 of the Indian Penal Code.
3. It is alleged that this petitioner made video of the daughter of the informant while she was taking bath. It is further alleged that on basis of that video he used to blackmail the victim and threaten to make the video viral.
4. It is submitted that informant and petitioner are close neighbour and due to dispute over pathway this false and concocted case has been lodged against the petitioner. There is 10 days delay in lodging FIR for which there is no plausible
Patna High Court CR. MISC. No.31435 of 2023(2) dt.21-07-2023 2/2 explanation which itself creates doubt over the veracity of prosecution case.
5. Learned counsel for the State opposes the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M, Benipur, Darbhanga in connection with Ghanshyampur P.S. case no 170 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
