Petitioner apprehends his arrest in connection with Baligaon P.S.Case No. 13 of 2018 registered for the offences punishable under Sections 376, 511 of the Indian Penal Code and Sections 11 and 12 of POCSO Act.

Allegation against the petitioner is of attempting to commit rape upon the minor daughter of informant. Submission of learned counsel for the petitioner is that false and concocted case has been lodged in order to create pressure to marry the daughter of the informant and further the statement of victim girl recorded under Section 164 Cr.P.C. shows that petitioner has misbehaved with her.

Heard learned APP and learned counsel for the

Patna High Court Cr.Misc. No.41831 of 2018 (2) dt.19-07-2018 2/2 informant, who has opposed the prayer for anticipatory bail stating that petitioner has attempted to commit on a minor girl. Having heard both sides and in view of allegation, I am not inclined to grant privilege of anticipatory bail to the petitioner, rather petitioner to surrender and make prayer for regular bail.
