JUSTICE SANJAY PRIYA ORAL ORDER 27-11-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in Kanti (Panapur O.P.) P.S. Case No. 5 of 2017 instituted for the offence under Sections 302/34 of the Indian Penal Code.
Counsel for the petitioner has submitted that in the post mortem report, it is mentioned that the death has occurred due to hemorrhage, coma and shock.
Counsel for the informant has appeared and submitted that the Doctor has found in the post mortem report that death has been caused on account of injury caused by impact of hard and blunt object, which supports the allegation against the petitioner, of dashing the deceased with Bolero vehicle. Further, it is submitted that the petitioner is the man of criminal antecedent and
Patna High Court Cr.Misc. No.53777 of 2017 (4) dt.27-11-2017 2/2 eight cases are pending against him.
From the written report, it appears that there is specific allegation against the petitioner that he along with other accused assaulted the son of the informant and when the informant was informed about such occurrence he reached to save his son then the petitioner dashed the son of informant with Bolero driving in high speed, on account of which he sustained serious injury and later on, he died in the hospital. The Doctor in the post mortem report has found the injuries, having been caused by impact of hard and blunt object.
Therefore, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, prayer for anticipatory bail is rejected. (Sanjay Priya, J) ajay gupta/- U T
