JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 10-11-2020 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. The petitioner is in custody in connection with S. Tr. No. 100 of 2020 arising out of Narali Kala Khurd P.S. Case No. 37 of 2019 for the offence under Section 302 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner has earlier approached this Court in Cr. Misc. No. 2677 of 2020. The application for bail was rejected vide order dated 20.02.2020 with an observation that the petitioner may renew his prayer for bail after framing of charge. Learned counsel further submits that charge has been framed on 24.06.2020 and thereafter there is no progress in the trial and as

Considering the fact that the allegation was levelled against unknown persons of strangulating the mother of the informant with Gamchha and also the observation of this Court vide order dated 20.02.2020 passed in Cr. Misc. No. 2677 of 2020, the Court is inclined to grant bail to the petitioner. The petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.50,000/- (Rupees fifty thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-XI, Aurangabad in connection with S. Tr. No.100 of 2020 arising out of Narali Kala Khurd P.S. Case No. 37 of 2019.
