====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 13-12-2021 Heard learned counsel for the petitioner and the State. The petitioner prays for grant of regular bail in a case registered for the offence punishable under section 399 and other ancillary sections of the Indian Penal Code and sections 25(1-B)a, 26 and 35 of the Arms Act.

As per the prosecution case, police conducted raid and recovered one country made pistol with a live cartridge from co-accused persons who disclosed the name of the petitioner and others as their associates who fled away from the place of recovery on seeing the police party.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioner. Petitioner's name has

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate VI Saran at Chapra in Nayagaon Police Station Case No. 32 of 2016.
