The petitioner apprehends his arrest in a case registered for the offence under Section 307 & other allied sections of the Indian Penal Code.

As per the prosecution case, 53 named including this petitioner and 150 unknown persons attacked the police party as a result of which some of the police personnel sustained injury. It is submitted on behalf of petitioner that allegation is general and omnibus against this petitioner and no specific overt act has been alleged against him. Three similarly situated coaccused persons have already been granted bail by this Court, vide order dated 29.08.2022 passed in Cr.Misc. No. 17221 of 2022. Petitioner has got clean antecedent.

Patna High Court CR. MISC. No.29723 of 2022(2) dt.26-09-2022 2/2 Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, in connection with Motihari Muffasil Police Station Case No. 573 of 2021, corresponding to G.R.
