The petitioner seeks bail in connection with Maranchi (Pachmahla O.P.) P.S. Case No.152 of 2023 registered for the offence under Sections 452, 341, 307, 384, 504, 506/34 of the Indian Penal Code and Sections 25(1-b)a, 26, 27 and 35 of the Arms Act.

Allegation against the petitioner is to have made four round fire, while demanding extortion money. 4.

Learned counsel appearing on behalf of the petitioner has submitted that petitioner has falsely been

Patna High Court CR. MISC. No.33508 of 2024(2) dt.20-05-2024 2/3 implicated in the present case. It is submitted that nothing has been recovered from the possession of this petitioner. It is further submitted that petitioner is a man of clean antecedent and he is in custody since 20.11.2023.

Learned APP appearing for the State, opposes the prayer for bail of the petitioner. 6.

In view of the submissions, as made above, as it appears from perusal of FIR, seizure list and impugned order that allegation against this petitioner is to have made four round firing and on next day a country made pistol was recovered from the possession of this petitioner and other coaccused, namely, Kundan Kumar granted bail by this Court as only one live cartridge has been recovered from his possession, where, allegation against this petitioner is very serious and different from other co-accused persons, this Court is not inclined to grant bail to the petitioner.

Accordingly, the prayer of bail of the petitioner is rejected herewith.

Learned trial court is directed to conclude the trial within a period of 06 (six) months from the date of order and if the trial could not be concluded within specified period, the petitioner would be at liberty to renew the prayer for bail of
