The petitioner has renewed his prayer for bail in a case registered under sections 304B and 34 of the Indian Penal Code.

As per the prosecution case, the petitioner and the members of his family are said to have assaulted and tortured the daughter of the informant and of having ultimately killed her.

It is submitted by learned counsel for the petitioner that the earlier prayer for bail of the petitioner was rejected vide order dated 6.12.2021 directing the learned trial court to expedite the trial. The allegations against the petitioner are general and omnibus in nature. There are no eye witness to the occurrence. The petitioner is in custody since 15.11.2019 and

Patna High Court CR. MISC. No.33283 of 2022(3) dt.10-08-2022 2/2 inspite of charge having been framed in the learned trial court on 6.11.2020, no witness has been examined on behalf of the prosecution inspite of more than one year nine months having passed.

Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the allegations in the F.I.R., the petitioner having remained in custody since 15.11.2019 and no witness having been examined inspite of charge having been framed in the learned trial court on 6.11.2020, the Court directs the petitioner to be enlarged on bail in connection with Sessions Trial no.149 of 2020 (arising out of Chhatapur P.S. Case no.256 of 2016 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge 1st -cum-Special Judge, Supaul.
