This application for anticipatory bail arises out of Rupaspur P.S. Case No. 42 of 2015 for the offence punishable under Section 379 of the Indian Penal Code and Section 3/4 of Bihar Conduct of Examination Act.
It is alleged that the petitioner, who was aspirant for the post of Constable, had fled away from the examination center of the written examination with the carbon copy of his answer sheet.
It has been submitted on behalf of the petitioner that he did not have any knowledge about lodging of the First Information Report in 2015 and recently in 2019, when the police attempted to approach him in his village home in the district of Rohtas, he learnt about the present criminal case. It has been argued that there is no chance of petitioner's fleeing

Considering the facts and circumstances and the nature of allegation, this application is allowed. Let the petitioner above named, in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-II, Danapur, in Rupaspur P.S. Case No. 42 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
