JUSTICE MOHIT KUMAR SHAH ORAL ORDER 15-02-2018 Heard the learned counsel for the petitioner, learned counsel for the informant and the learned A.P.P. for the State. This is an application for grant of anticipatory bail in connection with Dhanarua P.S. Case No. 478 of 2017 registered for the offences punishable under Section 302 of Indian Penal Code.
The case of the prosecution is that the younger son of the informant namely Rajesh Prasad has been murdered by the accused persons.
Learned counsel for the petitioner submits that the petitioner is an aged widow lady and has got no complicity in the said case. It appears that the case diary was called for by this court and upon perusal of the same, it appears that the Supervisory
Patna High Court Cr.Misc. No.61442 of 2017(5) dt.15-02-2018 2/2 Officer, Masaurhi has opined that there is no motive on the part of this petitioner for killing the son of the informant. Learned counsel for the APP duly assisted by the learned counsel for the informant have vehemently opposed the prayer. Having regards to the facts and circumstances of the case, I deem it fit and appropriate to admit the petitioner to the privilege of anticipatory bail. Accordingly, the abovenamed petitioner, in the event of her arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub Divisional Judicial Magistrate, Masaurhi in connection with Dhanarua P.S. Case No. 478 of 2017 subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure. (Mohit Kumar Shah, J) khushbu/- U T
