Learned counsel for the petitioner is permitted to remove defect(s), as pointed out by the office, if any, within a period of four weeks from today.
This application for anticipatory bail arises out of Ahiyapur P.S. Case No. 348 of 2020 for the offence punishable under Sections 272 and 273 of the Indian Penal Code and under Sections 30(a)/36 of the Bihar Prohibition & Excise Act. It is being submitted by learned counsel for the petitioner that the husband of the petitioner was subsequently apprehended by the Police in connection with present case and has been granted regular bail.
Considering the above, let the petitioner, above named, in the event of her arrest/surrender within four weeks
Patna High Court CR. MISC. No.39656 of 2021(2) dt.10-12-2021 2/2 from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act, Muzaffarpur, in connection with Ahiyapur P.S. Case No. 348 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. However, before accepting the bail bonds of the petitioner the Court below shall verify whether the husband of the petitioner has been arrested and granted regular bail or not. If it is found that the husband of the petitioner has been arrested and granted regular bail then the Court below shall accept the bail bonds of the petitioner and if the statement is found to be incorrect then the Court below shall not accept the bail bonds of the petitioner.
