Petitioner claims that in view of the supply order given to him for supply of furnishing materials in S.K. Memorial Hall, Patna during the year 2012-13 on the occasion of the visit of the President of India and in view of the N.I.T. published for the said purpose the supply was made promptly by him and the respondent no.5 had written a letter dated 08.02.2013 to the Commissioner, Patna Division sending the record for doing the needful. However, it is contended, that till date no payment has been made for the aforesaid supply

Patna High Court CWJC No.7140 of 2015 dt.20-05-2015 2/2 materials to the petitioner and the due amount is a sum of Rs.4,35,000/-.

Having regard to the facts and circumstances of the case, this writ application is being disposed of with a liberty to the petitioner to approach the respondent no.2, i.e., the Commissionercum-Secretary, Building Construction Department, Government of Bihar, Patna by filing a representation along with a copy of this order. On such representation having been filed, the respondent no.2 would be obliged to examine the claim of the petitioner. If he comes to the conclusion that admitted amount has not been paid to the petitioner then he will take steps for its payment within a period of eight weeks failing which the petitioner would also be entitled for simple interest @ 10% per annum on unpaid amount to be calculated from the date it became due till its final payment.
