The petitioner apprehends his arrest in connection with Case No. C2A-74 of 2018, registered under Section 30(a) and 35(a) of the Bihar Prohibition and Excise Act. The accusation is of recovery of 48 bottles, each containing 180 ML, 12 bottles, each containing 750 ML India made foreign liquor from the road situated adjacent to the house of the petitioner.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent and he has falsely been implicated in this case mere on suspicion due to recovery of seized illicit liquor near the house of the petitioner. Having regard to the facts and circumstances of the
