The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 447, 341, 323, 307, 379, 427/34 of the Indian Penal Code and Section 27 of the Arms Act.
The prosecution case as per F.I.R is that all the accused persons including petitioners, came at the shop of the informant and assaulted the informant. It is further alleged that petitioners shot fire, to which informant narrowly escaped and co-accused damaged the property and
Patna High Court CR. MISC. No.31600 of 2022(2) dt.22-11-2022 2/2 took the money from cash-box of the informant. It is submitted by learned counsel for the petitioners that petitioners are innocent and they have falsely been implicated in the present case. It is also submitted that neither anybody got injury nor empty cartridge has been found from the place of occurrence. Petitioners have no concern with the alleged motorcycles. In the facts and circumstance of the case, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura in connection with Madhepura P.S. Case No. 736 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
