Petitioner is seeking anticipatory bail in connection with Palasi P.S. Case No.232 of 2016 registered for offences punishable under Sections 135 and 138 of the Electricity Act. Learned counsel for the petitioner submits that, as per the allegation, the petitioner was found using electricity illegally from one L.T. line through PVC wire in his welding shop. The informant has alleged revenue loss of Rs.3,52,712/-. He further submits that in order to show his bona fide, the petitioner is ready to deposit the entire amount of Rs.3,52,712/- in three installments in the court below subject to result of the present case.

In the facts and circumstances of the case, if the

Patna High Court Cr.Misc. No.53896 of 2017 (2) dt.09-11-2017 petitioner deposits a sum of Rs.1,45,000/- for the present within a period of four weeks, in case of his arrest or surrender he shall be enlarged on bail on furnishing bail bonds of Rs.25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-III, Araria in connection with Palasi P.S. Case No.232 of 2016. This will be subject to his own undertaking that he will deposit the balance amount in two more installments within next three months, failing which the bail bond of the petitioner may be cancelled at the instance of the informant.
