It is submitted the counsel of the petitioner was engaged in some other Court resulting, no one has appeared on behalf of the petitioner. The case of the petitioner is very good in facts as well as in law. There was no deliberate latches on the part of the petitioner and undertakes to be vigilant in future.

Under the circumstances, the criminal miscellaneous No. 44814 of 2012 is hereby restored to its original file and number for hearing.
