The petitioner has preferred this application for grant of regular bail in connection with complaint case wherein cognizance has been taken under sections 420 and 120B of the Indian Penal Code.

As per the prosecution case, it is stated by the complainant that inspite of making payment of Rs. 42.5 lacs by the complainant, the accused persons including the petitioner herein did not transfer the agreed land to the complainant. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. Not a single farthing has been received by the petitioner from the

Patna High Court CR. MISC. No.39453 of 2021(2) dt.18-01-2022 2/2 complainant and none of the accounts mentioned in the complaint belong to this petitioner. The allegations are purely civil in nature. The petitioner is in custody since 31.1.2021. Heard learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the nature of allegation with the categorical assertions of the petitioner that he has not received a single farthing, the accounts mentioned do not belong to him together with the petitioner having remained in custody for over 11 months, the petitioner is directed to be enlarged on bail in connection with Complaint Case no. 1073C of 2017 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Danapur, district Patna.
