Petitioners apprehend their arrest in connection with Pakaridayal P.S.Case No. 29 of 2018 registered for the offences punishable under Sections 147, 148, 149, 323, 324, 504, 506, 379, 307 of the Indian Penal Code and Sections 3/4 of Prevention of Damage of Public Property Act.
Allegation as per FIR is that 100-150 persons assembled when a person died in the hospital and assaulted the Medical
Patna High Court Cr.Misc. No.40689 of 2018 (2) dt.13-07-2018 2/2 Officer and other staff. Petitioners are not named in the FIR but later on their names transpired during course of investigation. Submission of learned counsel for the petitioners is that there is no specific allegation attributed against them and they have no criminal antecedents.

Having heard both sides and in the facts and circumstances, let the petitioners, named above, in the event of their arrest or surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-V, East Champaran, Motihari, in connection with Pakaridayal P.S.Case No. 29 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C. and further condition is that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
