The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 394/34 of the Indian Penal Code.

The prosecution case got initiated as per written report of Pramod Kumar Sah, dated 16.08.2013 to the SHO, Dalsingsarai P.S. is to the effect that on the same day, the informant along with his friend, Ram Kishore Choudhary was coming from Sheora market to Dalsingsara, on the way, three persons robbed Rs.20,000/-, a mobile phone and motorcycle from them. Subsequently, on enquiry, the informant came to know that the theft was committed by Biran Sada @ Virendra Sada, the petitioner, Ranjeet Rai and Ranjeet Kumar Singh.

It is submitted by learned counsel for the petitioner that only on suspicion the accusation has been levelled. The

Patna High Court Cr.Misc. No.39707 of 2018(2) dt.11-07-2018 2/2 informant has substantially retracted from the initial version. Keeping in view the nature of accusation and serious criminal antecedent of the petitioner, as stipulated in paragraph no.3 of the petition, this Court is not inclined to enlarge the petitioner on bail.

Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Dalsingsarai P.S. Case No.281 of 2013, pending before the learned ACJMII, Dalsingsarai, Samastipur. With the above observation, this application is, accordingly, disposed off.
