JUSTICE VINOD KUMAR SINHA ORAL ORDER 15-07-2019 This application, for grant of anticipatory bail, arises out of Sursand P.S. Case No. 07 of 2019, disclosing offences under Sections 363, 366A, 504 and 34 of the Indian Penal Code.
Allegation is that the minor daughter of the informant was traceless and the villagers disclosed that they have seen his daughter along with the petitioners going in a tempo, as such, he suspects the hands of petitioners in the kidnapping of his daughter.
Submission of learned counsel for the petitioners is that they have falsely been implicated in this case and during
Patna High Court CR. MISC. No.28167 of 2019(3) dt.15-07-2019 2/2 investigation, it has come that only co-accused Bittu Kumar was seen going with the daughter of the informant and petitioners being mother, sister and brother in law of the said Bittu Kumar has been made accused it his case.
Heard learned A.P.P. also.
Having heard both sides, considering the fact that petitioner nos. 1 and 2 are ladies, as such, in the event of their arrest or surrender before the court below within six weeks from the date of receipt / production of a copy of this order are directed to be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned SDJM, Pupri, Sitamarhi, in connection with Sursand P.S. Case No. 07 of 2019, subject to the condition laid down under Section 438
(2) of the Code of Criminal Procedure.
So far petitioner no. 3 is concerned, I am not inclined to grant him the privilege of anticipatory bail. This application is accordingly disposed of.
