2. The petitioner seeks bail in connection with Dhangai P.S. Case No. 112 of 2024 registered for the offence under Sections 126(2), 115(2), 119(2), 191(2), 190, 109, 352, 351(2), 351(3), 103(1) of BNS.

3. The petitioner is named in the F.I.R. and is in custody since 24.12.2024.

4. The allegation against the petitioner is to assault the informant and family members by using farsa, lathi, rod etc. alongwith co-accused persons where it is specifically alleged that co-accused Guddu Yadav assaulted father of the informant which proved fatal. The

Patna High Court CR. MISC. No.28401 of 2025(3) dt.21-08-2025 2/3 allegation of assault is also available against co-accused Kailash Yadav and Baban Yadav.

5. Learned counsel appearing on behalf of the petitioner submitted that allegation against petitioner is very much general and omnibus rather same is specific against Guddu Yadav to cause fatal assault on the head of the father of the informant. It is pointed out that similarly situated co-accused namely, Jagdish Yadav already granted bail by one of the learned co-ordinate Bench of this Court through Cr. Misc. No. 30217 of 2025 vide order dated 24.06.2025 and as a matter of judicial parity this petitioner also deserves bail. While concluding the argument, it is submitted that petitioner is a man of clean antecedent and moreover, investigation of this case is completed, for which charge-sheet has been submitted, as such, there is no chance of tampering with the evidence.

7. In view of aforesaid factual submission and by

No.28401 of 2025(3) dt.21-08-2025 3/3 taking note nature of accusation and also that similarly situated co-accused already granted bail by one of the learned co-ordinate Bench as discussed aforesaid, coupled with fact that investigation of this case already completed where petitioner remains in custody since 24.12.2024, accordingly petitioner above named, is directed to be released on bail in connection with Dhangai P.S. Case No. 112 of 2024 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned JM 1st Class, Sherghati, Gaya /concerned court, subject to the conditions as mentioned under Section 437(3) of the Cr.P.C/ Section 480(3) of BNSS.
