Mr.Arun Kumar Pandey ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 07-05-2025 Heard learned counsel for the petitioners and learned APP appearing on behalf of the State.

2. The petitioners apprehend their arrest in connection with Barari P.S. Case No. 355 of 2023 for the offences punishable under Sections 341/323/324/325/307/34 of the Indian Penal Code.

3. The prosecution case in brief is that on 10.11.2023, all the accused persons including these petitioners assaulted the informant and his son by means of iron-rod and sword.

4. Learned counsel for the petitioners submits that the petitioners are quite innocent and have committed no offence. He further submits that specific acquisition of assault is against other co-accused persons. So far as these petitioners are

Learned counsel for the petitioners further submits that the injuries sustained by the victims, are simple in nature. The petitioners claims clean antecedent.

5. Learned Additional Public Prosecutor appearing on behalf of the State has vehemently opposed the prayer for bail.

6. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within eight weeks from today, the petitioners be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM1, Katihar in connection with Barari P.S. Case No. 355/2023, subject to the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973.
