2. The petitioner has preferred this application for grant of regular bail in connection with POCSO Case No. 110 of 2023, arising out of Triveniganj P.S. Case No. 454 of 2023 dated 20.11.2023 registered for the offences punishable u/ss 370A, 376, 506 read with section 34 of the Indian Penal Code, section 3,4,5 of Immoral Traffic (Prevention) Act and section 04/06 of the POCSO Act and the learned special court took cognizance u/ss 370A, 120B, 376, 376D, 506 read with section 34 of the IPC and u/ss 3,4,5 of Immoral Traffic (Prevention) Act and section 04/06/ 17of the POCSO Act.

3. As per the prosecution case, police raided the

Patna High Court CR. MISC. No.32662 of 2024(2) dt.07-05-2024 2/3 cinema hall of the co-accused, Panchanand Yadav and apprehended two young girls and two women there. One of the victim girl disclosed that, six months ago the co-accused Kundan Ram and the petitioner started blackmailing her with her private photos with one Aditya Kumar. Thereafter the petitioner and the co-accused Kundan Ram dragged her in prostitution.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. There is specific allegation against the co-accused Panchanand Yadav. There is allegation against the petitioner for taking the said victim to the cinema hall of Panchanand Yadav. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 13.12.2023.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Supaul in connection with POCSO Case No. 110 of

7. The application stands allowed.
