====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 16-05-2025 Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. Petitioners seek regular bail in connection with Gurpa P. S. Case No. 129 of 2024 in a case registered for the offences punishable under Sections 51, 52 of the Bharatiya Nyaya Sanhita and Section 30(a) of the Bihar Prohibition and Excise Act.

3. As per prosecution case, total 1250 litres illicit liquor along with two motorcycles were recovered from the bush.

4. Learned counsel for the petitioners submits that no

No.28724 of 2025(3) dt.16-05-2025 2/2 incriminating material has been recovered from conscious possession of petitioners and they are no way connected with the aforesaid recovery. Petitioners are neither drivers nor owners of the vehicles in question and they have been made accused only on suspicion. Petitioners are in custody since 24.03.2025. Charge-sheet has already been submitted. Petitioner No. 1 has got two criminal antecedents out of which one is of similar nature, petitioner No. 2 has got one criminal antecedent of similar nature in which they are on bail and petitioner No. 3 claims clean antecedent.

5. Learned A.P.P. for the State vehemently opposed the bail application.

6. Considering the nature of allegation and period of custody, the bail application is allowed. Let the above named petitioners be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Exclusive Special Excise Court No. 4, Gaya in connection with Gurpa P. S. Case No. 129 of 2024.
