JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-07-2018 Heard the parties. The petitioners seek anticipatory bail in connection with Khagaria (Gangaur) P.S. Case No. Case No.729 of 2017, registered for offences punishable under Section 341, 323, 504, 363, 366(A)/34 of the I.P.C.

As per F.I.R., allegation against the petitioners along with other co-accused is of kidnapping the minor daughter of the informant and for the purpose of some enquiry when the informant went to the house of the accused persons, they assaulted the informant.

Submission of the learned counsel for the petitioners is that they have falsely been implicated in this case and the present F.I.R. was lodged after lapse of seven days without giving any

No.42118 of 2018 (2) dt.19-07-2018 2/2 reason and the statement of the victim girl recorded under Section 164 Cr.P.C. in which she has stated that her age is 19 years old and she has gone to Nani's house and Nani was solemnized her marriage with Bipin Sada, co-accused and the petitioners have no criminal antecedents.

Learned A.P.P. opposes the prayer for bail.

Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioners, above named, surrender before the court below within a period of six weeks from the date of the order, he will be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) each with two sureties of the like amount each to the satisfaction of Learned Chief Judicial Magistrate, Khagaria in connection with Khagaria (Gangaur) P.S. Case No. 729 of 2017, subject to the conditions as laid down under Section 438 ( 2) Cr.P.C. with other that bailors should be local having sufficient immovable property within the jurisdiction of the Court concerned.
