JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-07-2019 This is an application for grant of anticipatory bail in connection with Phulwaria P.S. Case No. 287 of 2018, disclosing offence under Sections 341, 323, 504, 506, 406, 498A/34 of the Indian Penal Code and Sections 3/4 of Dowry Prohibition Act.
Allegation against the petitioner is that petitioner assaulted the informant for demand of Rs. 4 lacs and ousted from the house.
Submission of learned counsel for the petitioner is that after filing of the case for divorce, the present case has been lodged.
Patna High Court CR. MISC. No.29857 of 2019(5) dt.19-07-2019 2/2 Heard learned A.P.P as well as learned counsel for the opposite party no. 2. They have opposed the prayer for bail on the ground that no amount has been paid to her for bearing her expenses. Further, she is ready for one time settlement. In view of that facts as stated above the opposite party no. 2 is directed to appear in matrimonial case no. 52 of 2009 with the dissolution for marriage by the petitioner and if so appear, the learned family court fixed the case for reconciliation between the parties and if they are ready to one time settlement in that regard so far present bail application is concerned. The petitioner is directed to surrender on 30.07.2019 and after surrender he released on bail on condition the petitioner shall give 3000/-per month to the opposite no. 2 for a period of one year and it is expected that mean time the opposite party no. 2 has been filed a maintenance suit for grant of maintenance. In the above observations this application is disposed of.
