JUSTICE ASHUTOSH KUMAR ORAL ORDER 02-11-2021 Mr. Nitya Nand Neeraj, the learned Advocate for the petitioners has requested for an out of turn hearing of this matter as the petitioners are 91 and 92 years of age respectively.

Regard being had to the age of the petitioners, this matter has been taken up today out of turn.

The petitioners, who are the parents-in-law of the deceased, seek bail in anticipation of their arrest in

Patna High Court CR. MISC. No.39447 of 2021(2) dt.02-11-2021 2/3 connection with Silao P.S. Case No. 10 of 2021, dated 22.01.2021, instituted for the offences under Sections 304(B), 201 and 34of the Indian Penal Code.

Though the petitioners have been made accused in this case but the accusation against them is absolutely false. They are persons of such age that they are not even able to perform their daily chores. They are absolutely dependent on their children and younger members of the family for their sustenance.

The husband of the deceased is in custody.

During the course of investigation also, it has been urged, nothing concrete has come against the petitioners. Regard being had to the facts afore-stated, especially the age of the petitioners, they, in the event of their arrest or surrender before the learned Court below within a period of eight weeks, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bihar Sharif at Nalanda in connection with Silao

Patna High Court CR. MISC. No.39447 of 2021(2) dt.02-11-2021 3/3 P.S. Case No. 10 of 2021, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

The application stands allowed.
