JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 31-08-2015 The petitioner seeks direction to the respondent Sub Divisional Officer, Araria to dispose of his application for grant of PDS licence in view of order dated 12.2.2008 passed by the District Magistrate cum Collector, Araria in Appeal No.268 of 2007-08.

It appears from the counter affidavit that the petitioner was granted licence after 20.2.2007 after notification of the PDS Control Order, 2001 on 20.2.2007.

The petitioner in support of his contention that his case is similar to that of other licensee, relies upon an order of this Court dated 4.11.2011 passed in C.W.J.C. No.14525 of 2008. In my view, the order dated 4.11.2011 passed in C.W.J.C.No.14525 of 2008 is not applicable in the petitioner's

Nonetheless, as the District Magistrate cum Collector, Araria has remanded the matter by order, dated 12.2.2008 passed in Appeal No.268 of 2007-08, the Sub Divisional Officer, Araria would dispose of the matter in accordance with law.
