JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-07-2018 Heard the parties. The petitioner seeks anticipatory bail in connection with Athmalgola P.S.Case No. 183 of 2016 (G.R. No. 1549 of 2016), registered for offences punishable under Sections 147, 148, 149, 341, 323, 307, 379, 504 and 506 of the Indian Penal Code. Allegation against the petitioner is that the petitioner assaulted the informant with lathi, causing injury on his head. Submission of the learned counsel for the petitioner is that he has not committed any offence and the police after investigation, charge sheet has been submitted but not under Section 307 of the I.P.C. It has also been submitted that the petitioner is accused in one case but he is on bail. Learned A.P.P. opposes the prayer for bail.

No.41463 of 2018 (2) dt.18-07-2018 2/2 Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioner, above named, surrenders before the court below within a period of six weeks from the date of the order, he will be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Barh in connection with Athmalgola P.S.Case No. 183 of 2016 (G.R. No. 1549/2016), subject to the conditions as laid down under Section 438 (2) of Cr.P.C. with condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.
