In this application, the petitioner apprehends his arrest for the offences in connection with Chapra Muffasil P.S. Case No. 60 of 2017 punishable under Sections 120(b), 147, 148, 149, 323, 341, 392, 427, 506 of the Indian Penal Code and Section 27 of the Arms Act.
This case has been lodged on the basis of complaint petition with an allegation that at the point of country made pistol, touched at the temple of the complainant, petitioner demanded the booty. He further, snatched Rs. 30,000/- along with his associates and also damaged the parts of the truck.
Patna High Court Cr.Misc. No.63125 of 2017 (2) dt.31-01-2018 2/2 Submission is of false implication and that earlier petitioner has lodged Chapra (Muffasil) P.S. Case No. 11 of 2017 against the informant and others and in retaliation, present case has been lodged against the petitioner and, as such, petitioner deserves sympathetic consideration.
Learned APP fairly submits that the petitioner has earlier lodged a police case.
Considering the facts and circumstances as stated above, the petitioner, in case of his surrender or arrest within four weeks from the date of receipt/production of a copy of this order shall be enlarged on bail on execution of bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Learned Chief Judicial Magistrate, Saran at Chapra in connection with Chapra Muffasil P.S. Case No. 60 of 2017 subject to the conditions as laid down in Section 438(2) of the Cr.P.C.
