Let the defects be removed within two weeks after opening of the physical court.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is languishing in custody for the offences punishable under Sections 302/201/120B of the Indian Penal Code.

Eleven named persons including the petitioner are suspected to have kidnapped to the grand-daughter of the informant. During investigation dead-body of the victim was recovered.

Submission is that there is no eyewitness of the

No.29411 of 2020(2) dt.09-11-2020 2/2 occurrence nor the petitioner was ever seen along with the victim and on similar allegation some other co-accused have been allowed bail by a coordinate Bench of this Court vide Annexure-2 as well as by another co-ordinate Bench referred in the order at Annexure-2.

Considering the entire facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Narpatganj P.S. Case No.136 of 2019, with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
