JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-09-2019 This is an application for grant of anticipatory bail in connection with Tarari P. S. Case No. 140 of 2018, disclosing offences under Sections 307, 498A, 323, 420, 120B of IPC and Section 3⁄4 of D.P. Act.

Allegation against the petitioner is that petitioner being husband of the daughter of informant pushed his daughter from the roof, causing serious injuries.

Submission of the learned counsel for the petitioner is that petitioner and his family members has taken her for treatment and got admitted in the hospital.

Heard learned A.P.P. also, who has opposed the prayer for anticipatory bail by stating that during the reconciliation

Patna High Court CR. MISC. No.28304 of 2019(5) dt.04-09-2019 2/2 proceeding also the court has found serious injuries on the person of daughter of the informant.

Having heard both sides, considering the above facts, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below and make prayer for regular. The provisional bail granted to the petitioner, vide order dated 01.05.2019 is recalled.

Let this order be communicated to the court concerned at once.
