2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 331(4), and 305 of B.N.S. and later on Sections 317(5) and 3(5) of B.N.S. were added.

3. The case of the prosecution, in short is that some unknown miscreants have committed theft in the house of the informant and they have taken away the jewellery and cash of Rs. 1,30,000/-.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has been falsely implicated in this case. Learned counsel for the

During course of investigation, co-accused Gandhi Prasad has given his confessional statement and he has named this petitioner. The petitioner has also given his confessional statement and has stated that he has purchased the stolen property from one Ramu Kumar and Suvir Porail at low price. Learned counsel for the petitioner has submitted that the petitioner is the owner of a jewellery shop. The only allegation against the petitioner is that he has purchased the stolen property. It has further been submitted that no T.I.P. of the stolen articles was conducted during investigation. It has further been submitted that at most the allegation against the petitioner is that of receiving the stolen property which is triable by learned Judicial Magistrate 1st Class. Petitioner is having no criminal antecedent and he is languishing in judicial custody since 27.02.2026.

5. Learned APP appearing for the State and learned counsel for the informant have vehemently opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named

Case No. 113 of 2026 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-II, Aurangabad.
