JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 16-10-2019 Seen the report submitted by the learned lower court annexing the explanation submitted by the Bench Clerk. It happens to be mere an eyewash in order to wrap own fault and for that, she is warned to be cautious in future. Considering the fact that all the prosecution witnesses have already been examined, prosecution case has been closed. That being so, the ball has gone into the court of petitioner. However, it is made clear that learned lower court has been directed to proceed with the trial on day-to-day basis till its culmination which the learned lower court will abide with and in terms thereof, the present petition now is found inappropriate, whereupon, is dismissed.
