2. Let it be kept on record.

3. Heard learned counsel for the petitioner, learned counsel for the complainant and learned Additional Public Prosecutor for the State.

4. The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 467, 468, 471 of the Indian Penal Code.

5. Petitioner is said to have committed fraud with the complainant.

6. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. Learned counsel for the petitioner has filed the

Patna High Court CR. MISC. No.39183 of 2021(5) dt.18-01-2024 2/2 supplementary affidavit in which it is stated that the petitioner is ready to deposit the loan amount of Rs. 1,40,000/- within six months in the account of Punjab National Bank from the date of order. He further submits that petitioner has no criminal antecedent as stated in para-3 of the bail application.

7. Learned APP for the State opposes the prayer for bail.

8. Considering the facts and circumstances of the case, let the above named petitioner in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be enlarged on provisional bail for six months on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Complaint Case No. 1373 of 2018, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.

9. Learned Court below is directed to confirm the bail bond of the petitioner after returning Rs. 1,40,000/- in the account of P.N.B.
