Patna High Court CR. MISC. No.25707 of 2020(2) dt.14-10-2020 2/3 Mr. Arun Kumar Gupta, learned counsel for the petitioners seeks permission to withdraw this application with respect to petitioner nos. 3, 4, 6 and 9, who have been arrested.

This application with respect to petitioner no. 3/Rajesh Singh @ Dhuran Singh, petitioner no. 4/Brajesh Singh @ Kiran Singh, petitioner no. 6/Vinod Singh and petitioner no. 9/Santosh Singh @ Muri Singh stands dismissed as withdrawn.

The petitioner nos. 1, 2, 5, 7, 8 and 10 seek bail in anticipation of their arrest in connection with Dhansoi P.S. Case No. 54 of 2020 dated 12.03.2020 instituted for the offence under Sections 147, 148, 149, 341, 323, 504, 506, 452, 325, 307 and 379 of the Indian Penal Code. Regard being had to the nature of accusation against petitioner no. 1/Ravindra Singh, petitioner no. 5/Satyendra Singh, petitioner no. 7/Lalbabu Singh, petitioner no. 8/Durgesh Singh and petitioner no. 10/Mukesh Singh, I am not inclined to grant anticipatory bail to them. Their prayer for grant of anticipatory bail is rejected.

No.25707 of 2020(2) dt.14-10-2020 3/3 However, if they surrender before the court below and seek bail, the same shall be heard and disposed of in accordance with its own merit without being prejudiced by the fact that the present petition on their behalf has not been entertained.

However, regard being had to the fact that there is no overt act attributed to petitioner no. 2/Rakesh Singh, he is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar, in connection with Dhansoi P.S. Case No. 54 of 2020, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
