2. The petitioner apprehends arrest in connection with Samastipur Muffasil P.S. Case No. 284 of 2025 lodged on 26.06.2025, for the offence punishable under Sections 126(2), 109(1) & 3(5) of the Bharatiya Nyaya Sanhita, 2023 and section 27 of the Arms Act, pending in the court of Additional Chief Judicial Magistrate-II, Samastipur.

3. As per the prosecution, FIR has been lodged against four named accused persons including the present petitioner. It has been alleged by the informant that all the accused persons forcefully asked his nephew to consume liquor and when he

Patna High Court CR. MISC. No.31499 of 2026(3) dt.17-07-2026 2/3 refused, then they have abused and assaulted him. Thereafter, co-accused Md. Shadan fired upon the informant's nephew by pistol while other accused persons were holding him. Later on, the informant's nephew was admitted to the hospital.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He submits that the allegation of firing is against other accused person and not against the petitioner. Counsel submits that only on the basis of suspicion, name of the petitioner has figured in this case. He further submits that the petitioner has one criminal antecedent in which he is on bail. Counsel submits that on previous occasion, this Hon'ble Court has pleased to call for the case diary along with injury report. Counsel further submits that the petitioner is ready to fulfill all the conditions whatsoever shall be imposed upon him.

5. Learned APP for the State opposes the prayer for bail of the petitioner and submits that as per the FIR, there is also allegation against the petitioner that he was member of the mob and caught hold of the victim, upon whom the other accused person fired. He further submits that in the case diary also, the same allegation has been supported.

6. As such, in the present facts and circumstances of

Patna High Court CR. MISC. No.31499 of 2026(3) dt.17-07-2026 3/3 the case, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for anticipatory bail of the petitioner stands rejected.
