The petitioner apprehends his arrest in Mahishi (Jalai) P.S. Case No.62 of 2017 registered under Section 392 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R. The name of petitioner figured in the case in confessional statement of co-accused Nagendra Yadav but it appears from the order sheet of learned Sessions Judge that the charge sheet against the petitioner has already been submitted under Sections 395 and 412 of the IPC after declaring the petitioner absconder. The petitioner is alleged to have looted the motorcycle and mobile of the informant. Having considered the facts aforesaid and the fact that the petitioner has already been declared absconder, I am not
