The petitioner is in custody in connection with Pear P.S. Case No. 197 of 2018 for the offences under Sections 307 of the Indian Penal Code and Section 25(1-b)a, 26, 35 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody since 28.10.2018. He further submits that the case was registered at the instance of SHO, Police Station Pear, Muzaffarpur. Referring to the prosecution case he submits that during the search one country made pistol was recovered from the possession of the petitioner.

Considering the fact that petitioner has no criminal

No.29951 of 2019(2) dt.06-05-2019 2/2 antecedent and he has remained in custody for more than six months, the Court is inclined to grant bail to the petitioner, let the petitioner, named above, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Court of learned Judicial Magistrate, 1st Class, Muzaffarpur in connection with Pear P.S. Case No. 197 of 2018.
