JUSTICE ANIL KUMAR SINHA ORAL ORDER 24-01-2022 Heard Mr. Anil Prasad Singh, learned counsel for the petitioner and Mr. Ganesh Prasad, learned Additional Public Prosecutor appearing for the State through video conferencing. Petitioner seeks regular bail in connection with Raniganj P.S. Case No. 163 of 2020 registered for the offences punishable under Sections 341, 323, 324 325, 307, 379, 447 and 504/34 of the Indian Penal Code 1860.

As per the prosecution case, the petitioner assaulted the informant by means of Farsa on his head.

Learned counsel for the petitioner submits that both the parties are co-villagers and there is a land dispute between them inasmuch as on the land purchased by the father of the petitioner, the informant and others are claiming their rights, due to which, scuffle has taken place between the parties. Patna High Court CR. MISC. No.39440 of 2021(2) dt.24-01-2022 2/3 counsel further submits that on the same date and time, a counter case has been lodged by the petitioner bearing Raniganj P.S. Case No. 164 of 2020 against the informant and others, in which, the side of the petitioners also sustained injuries and injury reports to this effect has been annexed as Annexure-4 series to the petition.

Referring to Annexure-2A, learned counsel for the petitioner submits that the injury received by the informant is simple in nature, petitioner is in custody since 13.2.2021 and charge sheet has already been submitted.

Regards being had to the submission made by the parties and taking into consideration the materials on record, the fact that both the parties are co-villagers, there is land dispute, case and counter case between the parties, the petitioner is in custody since 13.2.2021 and the injury sustained by the informant is simple in nature, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., VI, Araria, in connection with Raniganj P.S. Case No. 163 of 2020.
