Petitioner apprehends arrest in a case registered for the offence punishable under Section 30 (a) of New Excise Act 22.

Prosecution case is that 346.81 liters of foreign wine in bottles of different brand and size was recovered from Car. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioner. Petitioner claims clean antecedent.

Learned counsel for the State submits that the huge

Patna High Court CR. MISC. No.30287 of 2023(2) dt.19-05-2023 2/2 quantity of liquor recovered from the vehicle. It is further alleged that petitioner is the registered owner of the vehicle. Considering the facts of the case as also the fact that huge quantity of liquor has been recovered from the vehicle of which petitioner is registered owner, prayer for anticipatory bail is rejected.
