The petitioner has purchased LMV (Passenger) made by Scoda Auto India Private Limited bearing Chasis No. TM BBLF NAGDG 01698 and Engine No. CLN 241800 manufactured in 2013.

For the purchase of the said vehicle State Bank of India had financed Rs. 10 lacs whereupon the petitioner had purchased the said vehicle from Singh Motor Cars Private

Patna High Court CWJC No.2273 of 2015 (19) dt.25-04-2018 Limited (authorized dealer). The said vehicle was insured in the name of the petitioner by SBI General Insurance Company Limited vide letter dated 19.11.2013. The petitioner failed to pay the installment though he was informed to pay installment otherwise the vehicle will be taken in possession. Though petitioner has paid Rs. 34,475/- but he could not pay the entire amount, ultimately the vehicle was seized and as per the Bank, the said vehicle has been auction sold for an amount of Rs. 6,25,000/-. In such view of the matter, this court does not find any merit in the present writ petition. Accordingly this writ petition is dismissed.
