The petitioner is in custody in connection with Athmalgola P.S.Case No.338 of 2018 for an offence under Sections 302, 364/34 201 and 120B of the IPC. As per prosecution case this petitioner and other accused persons kidnapped the son of the informant and thereafter the informant's son was killed by the accused persons. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. He further submits that there is no eye witness to the alleged occurrence. It is further submitted that during course of investigation one coaccused Md. Saddam, has been arrested by the police who disclosed the name of this petitioner, has been granted regular

Patna High Court CR. MISC. No.30124 of 2019(3) dt.18-09-2019 2/2 bail by a coordinate Bench of this Court in Cr.Misc.No.39885 of 2019 vide order dated 28.08.2019. Petitioner is in custody since 28.12.2018 and having clean antecedent.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of SDJM, Barh in connection with Athmalgola P.S.Case No.338 of 2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
