JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-07-2019 This is an application for grant of anticipatory bail in connection with Manjhagarah P.S. Case No.125 of 2018, disclosing offences under Sections 302/34 of the Indian Penal Code.

Petitioners happens to be the Devar and Nanad of the deceased with an allegation that they along with their mother caused the death of the deceased by setting her on fire. Submission of the learned counsel for the petitioners is that as a matter of fact, she was caught fire while preparing the food but the petitioners have been made accused in this case. It has also been submitted that trial is still going on, in which the informant has not supported the prosecution case. It is also submitted that petitioner no.2 is unmarried Nanad, aged about

Having heard both sides, considering the above submissions, let the petitioners, above named, surrender before the court below by 17.07.2019 and on surrender, considering the fact that petitioner no.2 is unmarried lady, she will be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned C.J.M., Gopalganj, in connection with Manjhagarh P.S Case No. 125 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.

So far as petitioner no.1 is concerned, he is to make prayer for regular bail, which will be considered by the learned court below on the materials available on record. With the above observations, this application stands disposed of.
