2. The petitioner seeks bail in connection with Protest-cum-Complaint Case No. 1867 of 2021 / Samastipur Town P.S. Case No. 179 of 2019 registered for the offence under Sections 406, 420, 120-B/34 of the Indian Penal Code.

3. As per the prosecution case, the petitioner is accused of cheating the victim/informant.

4. The petitioner is in custody since 28.11.2023.

5. Learned counsel for the informant has opposed the application of the petitioner and has submitted that the bail

Patna High Court CR. MISC. No.34544 of 2024(12) dt.20-06-2025 2/2 application of other co-accused has been rejected by this Court. He further submits that the trial is progressing and three witnesses have already been examined.

6. Though, three witnesses have already been examined in the trial but three more witnesses are yet to be examined on the application of the prosecution.

7. Considering the period of custody, this application is allowed.

8. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Samastipur/concerned Court below in connection with Protest-cum-Complaint Case No. 1867 of 2021 / Samastipur Town P.S.
