====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 08-12-2020 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor representing the State through video conferencing.
The petitioner apprehends arrest in a case registered for the offence punishable under sections 498A/306/34 of the Indian Penal Code.
Prosecution case, in brief, is that the informant's daughter Puja Kumari was married to the petitioner about 10 years back and out of the wedlock they had a son and a daughter. It is alleged by the informant that on 22.2.2020 he received a suicide note through Whats app on his mobile phone stating that her father-in-law Radha Mohan Ram, sisters-in-law (Gotini) Kaushalaya Devi and Asha Devi, brother-in-law (Bhasur) Dev Kumar Ram, the petitioner Paras Nath Ram and
Patna High Court CR. MISC. No.29205 of 2020(2) dt.08-12-2020 2/3 Ramashankar Ram assaulted and tortured her since last one year. Thereafter, on 23.2.2020 the informant received information on his mobile phone that his daughter has committed suicide.
Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case only because of being husband of the deceased. He submits that in fact at the relevant time the petitioner was working at DADRA Resort, Dadra Nagar Haveli, Dadra and only after knowledge about death of his wife he reached Patna from Mumbai. In support of the submission, a copy of the flight ticket has been appended as Annexure 2 to the bail petition. Besides this, the deceased was having love affairs with one Rakesh Kumar which is evident from her letters contained in Annexure 3.
Learned counsel for the State opposes the prayer for bail and submits that there is allegation in the FIR that the petitioner and his family members were abusing and assaulting the deceased for last one year.
In the facts and circumstances of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender, let the petitioner mentioned above be enlarged on bail on

No.29205 of 2020(2) dt.08-12-2020 3/3 furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Bhojpur at Ara in Shahpur Police Station Case No. 52 of 2020, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
