The petitioner seeks regular bail in connection with the Chakand P.S. Case No. 404 of 2022, registered for the offences punishable under Sections 341, 323, 307, 379 and 324 of the Indian Penal Code.

As per the prosecution case, the allegation against the petitioner is that he assaulted the informant with brick causing head injury and he had caught hold the victim Santosh Kumar and another co-accused Purushottam Kumar had fired upon victim Santosh Kumar which caused injury to him on his face and neck. There is also allegation of snatching mobile set against the petitioner.

Learned counsel for the petitioner submits that there is

Patna High Court CR. MISC. No.30388 of 2023(2) dt.12-06-2023 2/2 land dispute between the parties due to which the petitioner has falsely been implicated in this case. The specific allegation of firing and causing gunshot injury is on co-accused Purushottam Kumar and not on the petitioner. Petitioner has two criminal antecedents in which he is on bail and out of which one case has been filed by wife of the informant. Petitioner is in jail custody since 13.01.2023.

Learned APP for the State assisted by Shri Binod Kumar, learned counsel for the informant has opposed the prayer for regular bail of the petitioner.

Considering the facts and circumstances of the case let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate First Class, Gaya in connection with Chakand P.S. Case No. 404 of 2022.
