JUSTICE ARVIND SRIVASTAVA ORAL ORDER 08-12-2017 Heard learned counsels for the petitioners and the State. Petitioners apprehend arrest in connection with Nabinagar P.S. Case No. 302 of 2017 registered for the offence punishable under sections 354, 341, 323, 448, 504/34 of the Indian Penal Code and section 8 of the POCSO Act.
Learned counsel appearing for the petitioner submits that petitioners have been falsely implicated in this case as it is quite surprising that a father, petitioner no. 1, alongwith his two sons, petitioner nos. 2 & 3, tried to outrage the modesty of the informant. The allegations levelled are totally baseless and imaginary. There is no medical report to support the prosecution case. Petitioners are men of clean antecedent.
