JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-06-2018 The petitioner is apprehending his arrest in connection with Daudnagar P.S. Case No. 343/13, registered for offences punishable under Sections 147, 148, 149, 341, 323, 307, 342, 504, 353, 117, 160, 186, 291, 332, 337 and 383 of the Indian Penal Code.
Prosecution case is that some persons including the petitioner had assembled and were protesting against the death of a person in road accident and they blocked the road and hen the informant came there with some other police personnel and tried to clear the road, then people started throwing the stones and bricks over the informant and other police party. It has been submitted on behalf of the petitioner that prosecution case is false and concocted. It has been further submitted that no specific allegation has been attributed against
Patna High Court Cr.Misc. No.38412 of 2018 (02) dt.29-06-2018 2/3 the petitioner. It is also submitted that other accused persons of this case, have earlier granted bail by this Court in Cr. Misc. No.3313/2016 dated 21.01.2016 and Cr. Misc. No.35995/2017 dated 10.08.2017.

Having heard both sides, considering the facts and circumstances of the case, let the petitioner above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Daudnagar, Aurangabad, in connection with Daudnagar P.S. Case No. 343/2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C, it is further subject to the condition that:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.
(ii) The petitioner shall cooperate in the investigation and make himself available as
Patna High Court Cr.Misc. No.38412 of 2018 (02) dt.29-06-2018 3/3 and when required by the police and on the event of failure on his part to appear before the police on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of his bail bonds.
